The California Supreme Court reversed a decision of the court of appeal. The court held that an attorney’s undertaking of activities directly adverse to the interests of a former client might constitute a breach of the attorney’s fiduciary duty to that client regardless of whether or not the activities were undertaken in the course of representing another client and regardless of not there was any actual disclosure of client confidences.

Oasis West Realty, LLC, owned property in Beverly Hills that it sought to redevelop with a hotel, condominiums, and other improvements. The project required city council approval.
