The First Appellate District affirmed a judgment. The court held in the published portion of its opinion that the Probate Code’s statute of limitations on claims against a decedent did not apply where an estate administrator, rather than the decedent, breached a contract that existed between the decedent and the plaintiff.
John Dacey and Burton Goldstein were partners at the law firm of Goldstein, Barceloux & Goldstein (GB&G). That firm and the firm of Desmond, Nolan, Livaich & Cunningham (Desmond) had handled various inverse condemnation cases against the State of California since 1986 (“flood cases”). Desmond and GB&G agreed to share equally in any fee recovery after payment of other attorneys.
