The Fourth Appellate District affirmed a judgment as modified. The court held that reliance by the People on two defendants’ “prison packets” that were prepared for non-testimonial purposes in order to prove their prior convictions did not violate the Confrontation Clause of the Sixth Amendment.

A jury convicted Michael Perez and Keith Hill of burglary. The trial court found that Perez had suffered a prior prison term under Penal Code §667.5(b), three prior serious felony convictions under §667(a)(1), and three prior strikes under §667(b)-(i). The trial court also found that Hill had similarly suffered two prior serious felony convictions and two prior strikes.
