The Fourth Appellate District reversed a judgment. The court held that the trial court erred in failing to consider a suppression motion on the basis of a substantially redacted affidavit in support of a search warrant rather than proceeding under People v. Hobbs (1994) 7 Cal.4th 948 to give the prosecution the choice of disclosing the remainder of the affidavit or having the motion granted.
Police were called to investigate a fight in a bar involving about 30 “biker guys.” They determined that the altercation was between members of the “Set Free Soldiers” and members of the “Hells Angels.” The officers detained seven men but released them after being unable to determine that a crime had been committed.
