The First Appellate District affirmed a judgment. The court held that a manufacturer’s use of a green water drop symbol on product packaging would not lead reasonable consumer to infer a third party’s endorsement of the product’s environmental superiority.

Fiji Water Company LLC marketed bottled water. The label for the product included a symbol of a green water drop. Consumer Ahana Hill understood the symbol to mean that Fiji water had been third-party certified as being environmentally superior to other bottled waters. Based on that assumption, she made regular purchases of Fiji bottled water for several months, paying about 15 percent more per bottle than she would have for competing products.
