The Fourth Appellate District denied a petition for a writ of mandate. The court held that the trial court did not abuse its discretion in determining that the receipt and excessive review by a plaintiff’s attorney of privileged documents of the opposing party warranted his disqualification.

In 2007, VeriSign, Inc., which provided internet infrastructure services, hired Grant Clark as its chief administrative officer. Clark was an experienced litigation attorney. He had also acted as in-house and general counsel for corporations. Clark signed VeriSign’s nondisclosure agreement, which included a provision that he would not remove VeriSign’s privileged or confidential information and would return such information to Verisign upon termination of his employment.
