The Fourth Appellate District affirmed in part and reversed in part a judgment. In the published portion of its opinion, the court held that the trial court had no authority to refuse to impose an alternate penalty mandated by statute.
Following trial before a jury, Joel Campos was found guilty of three counts of attempted willful, deliberate and premeditated murder; three counts of assault with a semiautomatic firearm; and one count of discharging a firearm at an occupied motor vehicle. The jury also found true allegations that Campos (1) committed the offenses for the benefit of a criminal street gang; (2) personally and intentionally used a firearm during the commission of the offenses; (3) personally discharged a firearm causing great bodily injury during the commission of the offenses; and (4) personally inflicted great bodily injury on a person who was not an accomplice.
