The Second Appellate District affirmed in part and reversed in part an order and remanded. The court held that a trial court erred in allocating a spouse’s severance pay to a single month for purposes of a stipulated support order that required him to pay a stated portion of his monthly compensation in excess of a specified amount.

Richard Samson and Elaine Tong were married in 1985 and separated in 2007. Tong petitioned for dissolution and sought temporary spousal support. Samson argued that spousal support should be based on his base salary as a mutual funds wholesaler with an adjustment for his sales commissions above that salary pursuant to In re Marriage of Ostler & Smith (1990) 223 Cal.App.3d 33.
