The California Supreme court affirmed a judgment of conviction and sentence of death. The court held that the admission of evidence regarding an accused murderer’s white supremacist views did not deprive him of a fair trial.

Kenneth Bivert and Leonard Swartz were inmates at Salinas Valley State Prison (SVSP). Bivert had been convicted of three counts of first degree murder and was serving a life term. Swartz had purportedly been convicted of child molestation. Bivert stabbed Swartz to death.
