The court of appeals affirmed a district court judgment in part and reversed in part. The court held that a crime victim restitution order could not be used to assign to a crime victim funds that an incarcerated defendant received for accrued child support on behalf of her minor children.
Mabelle de la Rosa Dann was charged with visa fraud and conspiracy to commit visa fraud, forced labor, unlawful conduct regarding documents in furtherance of servitude, and harboring an illegal alien for the purpose of private financial gain. The crimes arose out of conduct involving Dann’s live-in nanny and housekeeper, Zoraida Peña Canal.
