The Fourth Appellate District affirmed a judgment. The court held that allegations of a complaint were insufficient to state a claim for elder abuse in a survivor action, and the allegations of professional negligence barred by the statute of limitations.

Following the death of 87-year-old Roosevelt Grant, his children sued Paradise Valley Hospital, where he had been treated. They alleged claims for (1) violations of the Elder Abuse and Dependent Adult Civil Protection Act (Welf. & Inst. Code §15600 et seq.), (2) willful misconduct, and (3) wrongful death.
