The Fourth Appellate District affirmed a judgment. The court held that an order granting an anti-SLAPP motion with leave to amend is the functional equivalent of an order denying the motion.
Dean Martin was employed by the municipal water district for the City of Chino as executive manager of finance and administration. After several years on the job, Martin learned that a female employee of the agency had filed a racial discrimination complaint against the executive assistant of chief executive officer Richard Atwater. The employee, like Martin, was African American, and she worked in a department headed by one of Martin’s workers.
