The court of appeals affirmed in part and vacated in part a district court judgment. The court held that a high school teacher was entitled to qualified immunity with regards to a student’s claims that the teacher violated the Establishment Clause by making comments during classroom discussion that were critical of religion.

High school student Chad Farnan sued the Capistrano Unified School District and teacher James Corbett under 42 U.S.C. §§1983 and 1988, alleging that Corbett’s derogatory comments regarding religion violated the Establishment Clause. Farnan cited dozens of allegedly hostile remarks.
