The California Supreme Court reversed a decision of the court of appeal. The court held that an employer’s duties to maintain workplace safety pursuant to the California Occupational Safety & Health Act of 1973 were delegable to an independent contractor.
Anthony Verdon Lujan (Verdon) worked for Lloyd W. Aubry Co., Inc., an independent contractor. Aubry performed preventive maintenance and repair services for US Airways, Inc. at San Francisco International airport. As part of its operations, US Airways had a permit to use luggage conveyor belts owned by the airport.
