The Fourth Appellate District affirmed an order. The court held that a decedent’s family sufficiently alleged that her health-care service plan and her primary medical-care provider were joint tortfeasors in causing her death by delaying her recommended medical treatment and thus settled in good faith with the provider.
Elsie Martin was a subscriber of PacifiCare of California, a health-care service plan that was licensed under the KnoxKeene Health Care Service Plan Act, Health & Safety Code §1340 et seq., and doing business as Secure Horizons and PacifiCare Health Systems, LLC (collectively, PacifiCare). Bright Medical Associates, Inc., was a health-care provider that contracted with PacifiCare to deliver medical services to PacifiCare subscribers, including Elsie, who selected a Bright physician for her primary care.
