The court of appeals reversed a judgment of the district court and remanded. The court held that a federal drug agent’s alleged filing of a false probable cause affidavit in Atlanta to support the forfeiture of cash previously seized from Nevada residents who were traveling through Atlanta resulted in personal jurisdiction over him in the district of Nevada.
Gina Fiore and Keith Gipson were professional gamblers who both maintained residences in Las Vegas. Fiore and Gipson were returning to Las Vegas from a gambling trip to San Juan, Puerto Rico, through Atlanta, where they had to change planes. They both carried large amounts of cash in their carry-on luggage and their clothing. While changing planes, Fiore and Gipson were questioned by federal drug agents who included Anthony Walden. Walden asserted that a drug-detecting dog had alerted to Gipson’s carry-on bag and seized all of their cash.
