The court of appeals reversed a judgment of the district court and remanded. The court held that the California Supreme Court’s decision that a prisoner’s state habeas petition was timely on review rendered the prisoner’s subsequent federal habeas petition also timely under the Anti-terrorism and Effective Death Penalty Act.

On December 13, 2002, Enrique Trigueros was convicted in California state court for murder and attempted murder and sentenced to prison. In October 2005, some two and one-half years after Trigueros knew of his claims of ineffective assistance of trial counsel, as well as some eleven months after Trigueros’ conviction was final, he petitioned the trial court for writ of habeas corpus.
