The court of appeals affirmed a judgment of the district court. The court held that a City of Redondo Beach ordinance barring individuals from standing on a street or highway and soliciting, or attempting to solicit, employment, business, or contributions from an occupant of any motor vehicle was a facially unconstitutional restriction on speech.

Following numerous complaints of day laborers gathering and soliciting temporary employment from the sidewalks along the Artesia Boulevard corridor, and problems with persons using medians and other portions of the street to sell products, the City of Redondo Beach adopted an anti-solicitation ordinance. The ordinance prohibited individuals from standing on a street or highway and soliciting, or attempting to solicit, employment, business or contributions from the occupants of any motor vehicle.
