The bankruptcy appellate panel reversed bankruptcy court orders. The court held that the determination as to whether real property owned by debtors was the debtors’ principal residence had to be made as of the date of the debtors’ bankruptcy petition.
Salaheldin Abdelgadir and wife Afaf Wahbi owned a home in Las Vegas. They filed a petition for chapter 13 bankruptcy in which they listed the home as their primary residence and only real property. BAC Home Loans Servicing, LP held a first deed on trust on the property. Countrywide Home Loans Servicing, LP held a second deed of trust.
