The Fourth Appellate District denied a petition for a writ of habeas corpus. The court held that evidence of an inmate’s lack of insight into the reasons for his crime provided some evidence that he posed a current threat to public safety and was thus unsuitable for parole.
Police were summoned to the home of 61-year-old Richard Field, Sr., by a report that two persons were injured by gunshots, on February 1, 1987. They were met in the driveway by Jose Rodriguez, shot in the stomach and bleeding profusely. He was nearly hysterical and needed to be restrained. The police found Field dead in the living room, with a large amount of blood around his head. The house had been ransacked and telephone cords cut.
