Righthaven LLC is self-styled as “The Nation’s Pre-Eminent Copyright Enforcer” and is in the lucrative business of suing bloggers and website owners for copyright infringement of works originally created by a handful of domestic newspapers it calls clients. In connection with those suits, the firm has exacted hundreds of thousands of dollars in nuisance value settlements. But recent decisions finding that the firm lacked standing to purse infringement claims have put an abrupt end to that steady flow of settlement dollars. Assignment And Subsequent Infringement Suits

Righthaven’s modus operandi is simple. The firm enters into exclusive agreements whereby holding companies that own regional newspapers assign it the right to bring actions for copyright infringement of a newspaper’s online content. Righthaven then trolls the Internet — with proprietary search software — for infringers of that content and immediately files suit when one is identified.
