The Fourth Appellate District affirmed two judgments. The court held that signed waivers were ineffective to waive an assistant sheriff’s rights under the Public Safety Officers Procedural Bill of Rights Act to notice and an administrative hearing upon termination of employment.
George Jamillo served as an appointed assistant sheriff under Orange County Sheriff Mike Carona. Jaramillo complained of many asserted unethical and improper acts on the part of Carona. Carona summarily dismissed Jaramillo is March 2004. Jaramillo requested but was denied an administrative hearing. He subsequently sued the County for violating his rights under the Public Safety Officers Procedural Bill of Rights Act (POBRA), Gov’t. Code §§3300 et seq., the 14th Amendment and the whistleblower provision of Lab. Code §1102.5.
