The Fourth Appellate District affirmed an order granting a preliminary injunction. The court held that the City of Riverside’s zoning ordinance banning medical marijuana dispensaries throughout the city was not preempted by state law.

The Inland Empire Patient’s Health and Wellness Center, Inc. operated a medical marijuana dispensary (MMD) in Riverside, beginning in 2009. The MMD was an association of patient members who collectively cultivated medical marijuana and redistributed it to each other. The City of Riverside sued the Center and others affiliated with its operation, including the owners of the property on which the MMD was located (collectively “the Center”), seeking to close the MMD.
