The Sixth Appellate District reversed an order granting a petition for a writ of habeas corpus. The court held the decision of the Board of Parole Hearings that a prison inmate was presently dangerous and unsuitable for parole was supported by sufficient evidence.
Jesus Hernandez, following a court trial, was convicted in 1993 of second degree murder and found to have personally used a firearm in committing the murder. He was sentenced to 15 years to life, plus two years, for a total term of 17 years. In 2010, the Board of Parole Hearings found Hernandez unsuitable for parole.
