The Sixth Appellate District issued an order to show cause on a petition for writ of habeas corpus. The court held that a defendant made a prima facie showing of ineffective assistance of counsel who failed to renew a motion to dismiss after the preliminary hearing on a charge of causing a false insurance claim to be filed.
David Witcraft rear-ended another auto with a pickup truck, damaging the other auto and injuring its driver. Witcraft gave his insurance information to the other driver and to a law enforcement officer, to whom he also provided his driver license and registration.
