The Third Appellate District affirmed a judgment. The court held that substantial evidence supported the trial court’s determination that the former same-sex partner of the adoptive mother was a presumed parent of the children under the Uniform Parentage Act.

S.B. and S.Y. were in a committed, same-sex relationship for thirteen and one-half of the sixteen years between 1993 and 2009. During most of that time, they maintained separate residences, but S.Y. spent most nights at S.B.’s house. S.B. had always dreamed of having children, and S.Y. agreed to co-parent a child with her. After S.B.’s attempts to conceive a child through artificial insemination proved unsuccessful, S.B. adopted G.B. following his birth in 1999.
