The court of appeals affirmed in part and vacated in part a judgment of the district court and remanded. The court held that confirmation of an arbitration award in favor of a ministry of the Islamic Republic of Iran did violate any U.S. public policy under an international convention pertaining to the enforcement of foreign arbitral awards.

In 1977, Cubic International Sales Corporation, predecessor to Cubic Defense Systems, Inc., a domestic corporation, contracted with the Ministry of War of Iran, predecessor to the Ministry of Defense and Support for the Armed Forces of the Islamic Republic of Iran, for sale and service of equipment for the Iranian military. The Iranian revolution resulted in non-performance of the contracts.
