The Fifth Appellate District affirmed a dependency court order terminating a probate guardianship. The court held that a dependency court order granting the probate guardian reunification services did not prevent the dependency court from later terminating the probate guardianship, in the best interests of the minors, without first needing to address the termination of those services.

Linda M. was appointed the guardian of her grandsons D.R. and Xavier R. in 2005, when the boys were about four and five years old. Both boys had severe emotional and mental health problems. Over the years, those problems worsened. In 2010, the Tulare County Health and Human Services Agency removed the boys from Linda’s care amidst allegations that she had been abusing the boys and taking their psychotropic medications. The court initiated dependency proceedings and placed the boys in foster care. Linda was granted reunification services.
