The court of appeals reversed a district court order denying a preliminary injunction and remanded the action with directions. The court held that a state regulation was subject to preliminary injunction where it placed severely disabled individuals at serious risk of institutionalization by reducing hours of personal care services available under Medicaid.

In late 2010, Washington’s governor ordered an across-the-board reduction in general fund appropriations to all state agencies. The state’s Office of Financial Management implemented the order by directing each state agency to reduce its allotment from the general fund.
