The California Supreme Court affirmed a judgment of conviction and penalty. The court held that there was no error in the use of a jury commissioner to prescreen prospective jurors for a capital case; further, the defendant forfeited any claim of error by failing to object to the procedure in the trial court.

On the evening of October 26, 1997, Susan Eubanks shot her four children and then shot herself. Eubanks survived her injuries. The children all died.
