The court of appeals affirmed a district court’s dismissal of an action for lack of standing. The court held that persons seeking to challenge President Obama’s constitutional qualifications for the presidency lacked Article III standing because their claims were not sufficiently concrete or their asserted injuries were not redressable.

On the day that Barack Obama was sworn in and took office as President of the United States, a group of plaintiffs filed suit in federal district court. The plaintiffs included active, inactive or retired military personnel, state political representatives, federal taxpayers, at least one person claiming to be a relative of President Obama, persons who were political candidates during the 2008 general election, and a certified California elector for the American Independent Party in that election.
