The court of appeals denied in part and dismissed in part a petition for review of an order of the Board of Immigration Appeals. The court held that an agency decision on a conditional permanent resident’s petition to remove such conditions that was rendered within 90 days of the completion of the interview process with the resident did not violate the statutory mandate as to the timing of that decision.

Venkatraman Chettiar, a native and citizen of India, was admitted as a conditional permanent resident based on his marriage to Lourdes Soto, an American citizen. Pursuant to 8 U.S.C. §1186a(c)(3)(A), Chettiar and Soto submitted an I-751 petition to remove the conditions on his residence to the Citizenship and Immigration Service (CIS) shortly before the end of Chettiar’s conditional-residence period.
