Genetic test maker Affymetrix Inc. has agreed to buy back $95.5 million of notes bought by the investment firm Tang Capital Partners and others to settle a lawsuit filed in Santa Clara Superior Court.
Tang sued Santa Clara-based Affymetrix for fraud in December, claiming the company had used money set aside to repurchase the notes as collateral to finance its $330 million acquisition of eBioscience Holding Co., announced on Nov. 30.
