SAN FRANCISCO — David Boies is supposed to be in three places at once this summer.

U.S. District Judge Phyllis Hamilton on Tuesday set a June 18 date for the retrial of Oracle Corp.’s patent infringement suit against SAP subsidiary TomorrowNow, even though the Boies, Schiller & Flexner chairman is already scheduled to be in trial in New York and potentially before Judge William Alsup in Oracle’s high-stakes patent suit against Google Inc. over Java around that same time.
