The court of appeals affirmed a district court judgment in part, vacated in part, and remanded the action for resentencing. Applying the rule of lenity, the court held that where a district court lacked sufficient information to determine the order in which a jury determined guilt on multiple counts under 18 U.S.C. §924(c), it had to order the convictions so that the resulting mandatory minimum sentence was minimized.
