SAN FRANCISCO — You can’t call the Sixth District Court of Appeal a slowpoke. At least, not in the case of San Jose’s Measure B, a ballot measure proposing pension reform — excuse us, pension modification.

A mere six days after a Santa Clara County Superior Court judge mostly cleared the official ballot title and question for the June 5 election, the Sixth District on Tuesday issued a published opinion calling the language used by the city council impermissibly partisan. The court changed the title, “PENSION REFORM,” to “PENSION MODIFICATION,” and removed promises that the measure would protect police patrols, fire stations and other popular city services.
