The court of appeals affirmed a district court judgment in part, reversed in part, and remanded the action for further proceedings. The court held that, under intermediate scrutiny, the federal statute barring public broadcast stations from airing advertisements for goods and services on behalf of for-profit entities was a constitutionally valid restriction intended to address the real harm that commercial advertising would divert public broadcast programming to a lowest common denominator. The court held further that the statutory restrictions against such stations airing advertisements regarding public issues and political advertisements was an unconstitutional restriction on content-based speech.
