C.A. 4th

The Fourth Appellate district affirmed a judgment. The court held that a party’s dismissal without prejudice of unadjudicated claims did not preclude appellate jurisdiction over adjudicated claims so long as the dismissal was not accompanied by the parties’ stipulation to waive the applicable statutes of limitation as to those dismissed claims so as to permit them either to be prosecuted or to be dismissed with prejudice pending the outcome on appeal.
