Attorneys for a company that lost a $577 million judgment on appeal last month are now arguing that the decision was unfairly influenced by two justices who belatedly recused themselves from the appellate process.

“We do not raise this issue lightly, and we are confident the court will carefully consider it,” Arnold & Porter partner Jerome Falk Jr. wrote in a petition for rehearing filed Tuesday with the Second District Court of Appeal in Los Angeles.
