SAN FRANCISCO The Ninth Circuit’s environmental wars flared up Friday as Judge Milan Smith put his colleagues on blast over decisions he said are costing jobs in mining, timber and agriculture.
“No legislature or regulatory agency would enact sweeping rules that create such economic chaos, shutter entire industries, and cause thousands of people to lose their jobs,” Smith wrote in dissent from an en banc ruling that will require greater regulation of recreational gold mining.
