The court of appeals affirmed a district court judgment in part, reversed in part, and remanded the action for further proceedings. The court held that the Hawaii Department of Land and Natural Resources constitutionally regulated commercial weddings on the state’s unencumbered beaches except to the extent that the agency retained absolute discretionary authority to revoke an issued permit at any time for any reason and to add terms and conditions to an issued permit.
