The court of appeals affirmed in part and reversed in part a district court judgment. The court held that customers who participated in a tobacco company’s customer rewards program by collecting certificates with cigarettes they purchased, anticipating that the company would honor its offer to redeem the certificates for merchandise described in catalogs provided by the company, adequately alleged the existence of the an offer by the company to enter into a unilateral contract.
