The Fourth Appellate District reversed a judgment. The court held that a custodial suspects inquiry regarding the custodial status of a codefendant could not be construed as a renewed waiver of the suspects Miranda rights and a consent to the resumption of interrogation where the suspect had, moments before, unequivocally requested that questioning cease.
