SAN FRANCISCO — It’s a contract.

In its case against Oracle Corp., Hewlett-Packard Co. has persuaded Santa Clara County Superior Judge James Kleinberg that a partnership agreement signed by the two tech giants in 2010 amounts to a contract. That contract, Kleinberg said in a preliminary ruling Wednesday, means Oracle must backtrack on its plans to halt support of HP’s Itanium servers, and instead share, at no cost, its software for use on the machines for as long as HP chooses to sell them.
