C.A. 2nd

The Second Appellate District affirmed a trial court order. The court held that even if allegations of malfeasance by a homeowners association board member qualified as protected speech, the declarations submitted by the board member in support of her defamation claim demonstrated her probability of prevailing on the merits off her complaint, thus precluding dismissal of the complaint under the anti-SLAPP statute.
