The court of appeals affirmed a district court judgment. The court held that when promulgating incidental take regulations under the Marine Mammal Protection Act, the U.S. Fish and Wildlife Service must determine separately whether a particular activity will take only small numbers of marine mammals, and whether the take will have only a negligible impact on the pertinent species or stock.
