The California Supreme Court reversed a decision of the court of appeal. The court held that where one of multiple tortfeasors reaches a settlement with an injured plaintiff, which settlement is determined not to have been entered into in good faith, the common law release rule does not apply so as to release the remaining tortfeasors from liability; instead, the money paid by the settling tortfeasor is credited against any damages assessed against the nonsettling tortfeasors, who are allowed to seek contribution from the settling tortfeasor for damages they have paid in excess of their equitable shares of liability.
