The California Supreme Court affirmed a court of appeal decision denying a petition for writ of habeas corpus. The court held that whether or not imposition of a 25-year-to-life prison term for a recidivist offender’s failure to register as a sex offender constitutes cruel and unusual punishment depends on the facts of the case; in this case, the court found, the sentence imposed did not violate the Eighth Amendment.
