The court of appeals granted a petition for review of a decision of the Board of Immigration Appeals. The court held that where an alien’s eligibility for relief from deportation depends on the length of a prison term he served for an aggravated felony, a term of pretrial civil confinement in a psychiatric facility which was credited against his sentence had to be treated as analogous to a term of imprisonment, with the proviso that any good time credit earned during the alien’s incarceration in prison also had to be credited against the term of pretrial civil confinement.
