The court of appeals affirmed the district courts denial of a petition for writ of habeas corpus. The court held that a psychologists testimony that drugs or hypnosis might be used to test the defendants claim of memory loss did not constitute impermissible testimony regarding drug or hypnosis-induced memories where neither drugs nor hypnosis were ever used on the defendant.
